Question: If a 16 yr old girl is Questioned by an Investigator, and tells him her Uncle fondled her breasts about 2 yrs. ago, and there were no witnesses, no other evidence at all, and then the 16 yr old refuses to testify against the Uncle, would the case go to Court? And if so, would the DA have enough evidence to convict..Thanks!

Answer: The case would go to court, but the prosecutor would not be able to prosecute the case unless the girl testified. Let me suggest that if the prosecutor uses resources to get an indictment, arrest the defendant and schedule hearings, then the prosecutor will locate the victim and make her testify.
