Question: Recently went to jail in December 2010 for a shoplifting charge of 6.00. I went to municipal court and the judge bonded my case to state court. I contacted the state court and they told me it would take six months to a year to noticed of anything, whether they dismiss the case or not. I am very worried about this situation and I do not want this to go on my record. Im from Georgia.

Answer: What is your question? Will the prosecutor go forward on a $ 6.00 theft case. With the exception of Fulton and/or DeKalb County, YES the prosecutor will go forward. Next, the judge did not bind the case over to State Court on his own. YOU insisted that you are not guilty, and were not going to take any plea offer. THEN, the judge bound the case over to State Court. The case will come to court in the next 6-12 months. THEN, you will again decide if you are going forward with a trial (jury trial) or a guilty plea. If you have a jury trial, then you will need an attorney, retained or appointed. The arrest is already on your record, and will remain on your record for the 6-12 months while the case is pending. If you are found guilty, the conviction will be on your record FOREVER. If you are found not guilty, then you might be able to get the arrest expunged. Good luck.
